The SEC claims that the NASD and NYSE, though self-regulatory organizations supposedly tasked to enforce securities law and overseen by the SEC, are not "quasi-public" entities for purposes of FACA. "Quasi-public" status is determined by whether an entity is "permeated by" or "closely tied to" a federal agency.
